Service Agreement
Please read these terms carefully before using HostedFly services.
This agreement has been organized between HostedFly (hereinafter referred to as "COMPANY") and the person or institution benefiting from the services offered by the COMPANY (hereinafter referred to as "CUSTOMER"), to determine the conditions of use of the service.
1. Definition and Scope of Service
The COMPANY provides Web Hosting, WordPress Hosting, Domain Registration, Server Rental, and SSL Certificate services upon the CUSTOMER's request. The COMPANY undertakes to provide the necessary technical infrastructure to ensure the continuity of these services with a 99.8% Uptime guarantee.
2. Customer's Obligations
- The CUSTOMER is personally responsible for all content, files, and databases hosted on their website.
- The CUSTOMER cannot host content that is contrary to the laws of the Republic of Turkey, violates copyright, contains pornography, terrorist propaganda, or illegal betting.
- The CUSTOMER cannot overuse server resources (CPU, RAM, Disk) in a way that affects other users. Accounts exceeding the Fair Usage quota will be warned or suspended.
- The CUSTOMER is responsible for ensuring account security (strong password usage, etc.).
3. Prohibited Activities
- Sending unsolicited bulk emails (SPAM).
- Phishing and fraudulent pages.
- Organizing Botnet, DDoS attacks or using it as a command center.
- Distribution of pirated software (Warez), cracks, keygens.
- Running cryptocurrency mining scripts.
4. Fair Usage Policy
The hosting services offered are designed solely for the purpose of publishing websites and hosting files belonging to these sites.Therefore, the use of server resources (disk space, traffic, CPU, RAM) for purposes other than intended is strictly prohibited.The following situations are considered "Fair Usage Violations" and may result in the suspension of the service:
- Storage of files not directly related to the website (film, series, music archives, personal photo backups, ISO files, etc.).
- Using the hosting account as a file sharing center (File Sharing / Cloud Storage) (e.g., Google Drive or Dropbox alternative).
- Occupation of more than 25% of disk usage by email archives older than 90 days or website backup files (zip, tar.gz, etc.).
- Unauthorized distribution or storage of copyrighted materials.
When HostedFly detects such violations, it reserves the right to warn the user in advance, delete the infringing content to protect server stability, or temporarily/permanently suspend the account.
5. Pricing, Payment and Refund
Services are provided on a prepaid basis. Services not paid within the billing period are suspended within 3 days and completely deleted at the end of 7 days.
- Hosting Refund: For newly purchased hosting packages, an unconditional refund guarantee is offered within the first 30 days if you are not satisfied with the service.
- Domain Refund: Since domain registration processes are instantaneous and irreversible before ICANN and registry authorities, refund or exchange of domain names is not possible.
- License services (cPanel, Plesk, etc.) and SSL certificates cannot be refunded.
6. Backup and Data Loss
The COMPANY performs weekly automatic backups for all hosting accounts. However, these backups are an "extra security measure". The COMPANY cannot be held responsible for data losses that may occur as a result of possible hardware failures, data center problems, or cyber attacks. Data backup responsibility essentially belongs to the CUSTOMER.
7. Suspension and Termination of Service
The COMPANY has the right to terminate the service unilaterally in the following cases:
- Failure to make payment on time.
- Performing prohibited activities specified in Article 3 of the Agreement.
- Behaviors containing insults, threats, or defamation towards COMPANY employees or brand.
8. Force Majeure
In all cases deemed "force majeure" by law, the COMPANY is not liable for late or incomplete performance or non-performance of any of its obligations determined by this agreement. These and similar situations will not be deemed as delay, incomplete performance or non-performance or default for the COMPANY, or no compensation under any name can be claimed from the COMPANY for these situations.
The term "force majeure" will be interpreted as events that are unavoidable and beyond the reasonable control of the relevant party despite showing necessary care, including but not limited to natural disasters, riots, wars, strikes, epidemics, pandemics, government restrictions, prohibitions or obstructions in the import and export regime, communication problems, infrastructure and internet failures, power outages, intense cyber attacks (DDoS, Botnet, etc.) exceeding the COMPANY's existing security measures and DDoS protection capacity, and bad weather conditions.
9. Authorized Court
Konya Courts and Enforcement Offices are authorized for the resolution of disputes arising from the implementation of this agreement.
By placing an order via HostedFly, the CUSTOMER declares that they have read, understood, and accepted all provisions of this agreement.
